These Regulations define the general terms and conditions, rules and manner of sales carried out by " ŚLUSARSTWO KAMIŃSKI " Mateusz Kamiński with its registered office in Stromiec (Poland) under the brand name MORIA DESIGN, through an online shop operating at URL: https://www.moriadesign.pl (hereinafter referred to as the "Store") and sets out the terms and conditions for the provision of free electronic services by " ŚLUSARSTWO KAMIŃSKI " Mateusz Kamiński, with its registered office in Stromiec.
1. general provisions
The following Regulations apply to all orders placed by the Customer with the company: " ŚLUSARSTWO KAMIŃSKI " Mateusz Kamiński with registered office in Stromiec (registered office and delivery address: ul. Stok 4, 26-804 Stromiec, Poland); entered in the Central Register and Information on Business Activity; NIP: 7981467585; REGON: 146218800; operating under the trademark MORIA DESIGN, registered in the European Union Office for Intellectual Property under the number 018622009, using the website located at URL: https://www.moriadesign.pl or by telephone and e-mail in special cases (collectively, the "Shop").
By using the Shop you accept these Terms and Conditions.
MORIA DESIGN makes the Regulations available free of charge before the conclusion of a contract via the Store's website, and the Customer is obliged to become familiar with their content before placing an order. At the consumer's request, it is possible to make the document available in another way that enables him/her to acquire, reproduce and record the content of the Regulations by means of the tele-information system he/she uses.
In order to use the Shop and place orders, Internet access and an installed web browser are required (we recommend using the latest browser version).
The page for each product contains information such as a general description of the product, price, lead time, delivery time and method. This information is addressed to the general public and constitutes only an invitation to conclude a sales contract. The moment when the Customer receives an e-mail about the acceptance of the order for processing is considered as the moment when the sales contract is concluded.
The availability of products in the Shop may vary. We reserve the right to withdraw any product from sale at any time.
The customer is bound by the version of the Terms and Conditions available in the Shop at the time of ordering.

2. goods offered
All products are brand new and free from physical and legal defects.
Each product's website provides information on the product or types of products that are sold as a set.
We have the option to introduce time-sensitive promotions (e.g. periodic price reductions). The rules for taking advantage of a particular promotion are set out in its terms and conditions.
We may make changes to the prices of the goods offered at any time by entering a new price on the product page. Sales are carried out in accordance with the Terms and Conditions.
The information contained on the product/goods pages in the Shop does not constitute an offer by MORIA DESIGN within the meaning of the Act of 23 April 1964. - Civil Code (Dz.U.2020.0.1740 t.j.) of the Civil Code, but only an invitation for the Customer to make an offer. Placing an offer follows the steps listed in point 3 of the Terms and Conditions.
3 Placing orders
Orders can only be placed in the Shop by adults who have full legal capacity, according to the following steps:
- Customer selects product and adds to basket
- By default, one click on a product means selecting one item. You can increase or decrease the number of pieces of the ordered product in the shopping cart
- The customer chooses the method of payment and delivery
- If the customer has a discount code he can use it
- By proceeding and approving the shopping cart, the Customer places an order and then logs in (if he/she has an account with the Store), registers (an Account with the Store is created), purchases without registration (the Customer then has no access to an Account with the Store)
- The Customer provides his/her shipping and contact data in the case of purchases without registration (if the Customer creates an Account in the Shop, he/she additionally provides the e-mail address for logging in and sets the password for the Account, and if the Customer buys while logged in, he/she does not have to re-enter his/her address data, unless it is different from the data provided by the Customer in the Shop's Account)
- The Customer places an order in the Shop and pays for it. MORIA DESIGN sends information about acceptance of the order for execution within 5 days. The contract is concluded and the offer accepted as soon as the Customer receives confirmation of acceptance of the order for processing. The Customer receives such information together with information about the completion of the order. Subsequently, the customer receives information on dispatch of the goods.
MORIA DESIGN may not accept the order for processing and in such a situation the contract is not concluded. Any monies paid by the Customer will be refunded immediately.
In special cases, it is possible to place an order and process it outside the Shop by means of an e-mail or a telephone call. In such a case, prior to placing an order, the Customer will receive the Terms and Conditions at his/her e-mail address and will be asked to accept the Terms and Conditions and thus confirm his/her further wish to place an order, or the Customer will be asked to read them on the Shop website and confirm their terms and conditions (telephone orders).
4 Account in the Shop
Registration is voluntary. You must provide a login and password and confirm the activation link. After clicking on this, the contract for maintaining access to the Account is concluded.
You can change your password by clicking on the "Forgot your password?" option. You will need to enter your login and reset your password according to the instructions you received in the email.
You can delete your account at any time either by logging in or by sending us an e-mail to the address of the Shop: sklep@moriadesign.pl
The deletion of the Account shall entail the deletion of the data stored in it. We stipulate that we store information about your orders in the Shop for the purpose of establishing, asserting or defending legal claims.
We are entitled to delete an Account without informing the Customer, which the Customer has not logged into for more than 2 years.
5 Prices and delivery costs
The prices of the products displayed in the Shop include statutory VAT, but do not include delivery costs. Delivery costs are shown at the ordering stage.
The cost of delivery of an order varies depending on the method of transport chosen. The cost of each method of delivery is detailed at the stage of order finalisation. Delivery costs are also specified in the Delivery and payment.
6 Delivery
MORIA DESIGN accepts and processes orders with the utmost care. We will deliver the ordered products to the address provided by the Customer and to Inpost parcel machines in Poland, as well as to the addresses indicated in the EU member states, on working days, during working hours for the courier companies and depending on their logistic plans. Information on the expected delivery time is displayed before the order is placed. If the Customer provides his/her e-mail address, he/she will receive a confirmation e-mail with the expected delivery date of the order after placing the order.
If your order is not delivered by the specified date, please contact the Shop by e-mail: sklep@moriadesign.pl.
Please check the contents of your parcels, if possible in the presence of the courier, and if you find any damage to the product in transit, write a damage report with the courier.
7. cancellation of an order (withdrawal from the contract)
The customer may withdraw from the Contract within 30 days of receipt of the delivery. If the order had been paid in advance, a refund of the amount paid for the order will be made using the same payment method as the original order. MORIA DESIGN will not refund the delivery costs for the return of the order.

In the event of a return of goods (withdrawal), we will attempt to refund the money in the same way as the payment was made as soon as possible - within 14 days of receiving notification of the return of the products, provided that we have received the products or confirmation of their return.
If the product you receive is faulty, please inform us as soon as possible.
8 Returns
MORIA DESIGN guarantees a refund in accordance with the provisions of section 7 (Cancellation of the order) provided that all items of the order are returned in unaltered condition. This means that the product must not be damaged, modified or bear any signs of use. Furthermore, the product should have all tags and labels, if any. A product sold as a set cannot be returned in parts, but only in its entirety as purchased. The return procedure is described under Return.
9 Payment methods
PayU
Settlement of electronic payment and payment card transactions (with the exception of payment by bank transfer directly to MORIA DESIGN's bank account) is carried out according to the Customer's choice via PayU.pl. Electronic payment and payment card processing is carried out by:
PayU.pl - PayU S.A. company with headquarters in Poznań (address: ul. Grunwaldzka 182, 60-166 Poznań), entered in the Register of Entrepreneurs of the National Court Register under KRS number 0000274399, share capital of PLN 4,000,000 fully paid up, NIP: 779-23-08-495.
Cash on delivery
The order can be paid upon delivery: by payment card at the InPost parcel machine or by cash/card at the courier delivering the parcel (if the selected courier has the option of paying by card).
Traditional transfer
Payment by traditional bank transfer involves filling in the transfer form by hand with the relevant data. The customer can do this at the bank's branch or its online service. The following should be entered:
- the amount to be paid,
- recipient's data: " ŚLUSARSTWO KAMIŃSKI " Mateusz Kamiński, Stromiec ul. Stok 4, 26-804 Stromiec (registered office and delivery address: Stromiec, ul. Stok 4, 26-804 Stromiec, Poland),
- transfer title: order ID or invoice number.
10 Rights and obligations
The customer has the right to:
- manage your Account,
- use of the services in accordance with the Terms and Conditions,
- to make enquiries to the helpdesk and/or to lodge complaints,
- carry out the return within 30 days of receipt of the consignment
- delete the Account at any time.
The customer undertakes to:
- to make payment for the purchased goods (if the goods are collected and payment is not made, this is tantamount to misappropriation of property),
- use data and/or personal data which he has full rights to use (must not infringe the rights of third parties),
- prior verification that it meets the technical requirements for using the Shop,
- not to use the Shop in a way that interferes with its functioning and/or in a way that infringes the law,
- not to reproduce or modify material published in the Shop,
- to use the Shop in accordance with the law, the provisions of the Terms and Conditions and the principles of social coexistence. It is forbidden to use the Shop in order to carry out terrorist, sabotage or other criminal activities as well as to commit any violations of law or tort,
- update their personal data,
- not to take any action that is incompatible with generally applicable law or good morals, or that infringes the personal rights of others (including legal persons) or the legitimate interests of MORIA DESIGN or others (including legal persons),
- not to access other people's Accounts,
- not generate an excessive or disproportionate load on the connections and other infrastructure on which the Store operates,
- keeping his password a strict secret,
- not to make your Account available to others,
- not to use automated programs to collect information on the Store.
MORIA DESIGN does not interfere with the Customer's Account and the information stored therein, except when the Customer asks for it due to technical problems or someone reports a violation of rights and it is justified.
We have the right to:
- researching how visitors use the Shop by: the use of cookies, the collection of information on their use of the services (e.g. statistics) as well as providing information as part of online advertising targeting in accordance with the Privacy Policy,
- changes to the functionality or the appearance of the Shop, provided that this does not reduce the quality of the service provided or affect the Customer's rights in respect of personal data protection,
- delete the Customer Account in accordance with the Terms and Conditions.
We undertake to use our best endeavours to ensure that the Services are provided continuously and without interruption. However, we reserve the right to make all or part of the Shop temporarily unavailable due to technical reasons, in particular maintenance or changes. We will endeavour to make this unavailability as inconvenient as possible.
11. accountability
The client is fully responsible for its own acts and omissions.
MORIA DESIGN is not responsible for:
- data, including personal data provided by the customer,
- incorrectly entered data by the customer,
- lack of access to the Internet or restrictions on its availability,
- limitations and/or malfunctions of software or devices belonging to the Customer or on the Customer's side regarding the possibility of using the Shop,
- the damages and lost profits of the Customer caused by the disclosure of the Account password through the fault of the Customer,
- damages and lost profits incurred by the Customer, which are caused by the Customer's actions and/or omissions, in particular through improper use of the Shop,
- damages and lost profits incurred by the Customer if he/she has violated the law or the provisions of the Terms and Conditions, and whose Account has been deleted by MORIA DESIGN,
- damages and lost profits incurred by the Customer, which are caused by acts and/or omissions of third parties not bound by the terms of the contract of sale for the use of the Account and which are beyond our control,
- the damage suffered and the benefits lost by the Customer as a result of force majeure,
- the damage suffered and the benefits lost by a third party as a result of the acts and/or omissions of the Customer,
- hyperlinks to third party websites. These sites belong to and are managed by their respective administrators or service providers. MORIA DESIGN is not responsible for the availability or quality of these sites.
MORIA DESIGN does not verify the data provided by the Customer.
Nothing in these Terms and Conditions excludes or limits the liability of MORIA DESIGN in any matter where the exclusion or limitation of liability would be unlawful.
If there has been a problem with a product purchased from the Store and the complaint has not been resolved, the Customer may submit it to the EU online dispute resolution system ("ODR Platform").
The ODR platform offers EU consumers and sellers the opportunity to reach an out-of-court agreement on complaints about products bought online. This easy-to-use, interactive website is available free of charge in all official EU languages. The platform allows consumers and sellers to find an adjudicating body and then reach an agreement on a complaint. The ODR platform can be accessed at: https://ec.europa.eu/consumers/odr/main/index.cfm.

12. colours and dimensions
We endeavour to present our products, their manufacturing precision and colours as faithfully as possible. The way colours are displayed depends on the operating system and hardware used. We cannot guarantee that your computer, monitor or mobile device will reproduce the colours faithfully.
13 Complaints
In the event of non-conformity of the goods with the contract, the customer may claim the defective product.
MORIA DESIGN may resolve the complaint on the basis of the attached photos or ask for the faulty goods to be shipped and only resolve after physical inspection. The customer is obliged to keep the product until the complaint has been resolved.
Defective goods must be returned in the same condition in which they were purchased, i.e. complete (if a set or set has been purchased, they must be sent back as a whole).
The customer will receive a reply from us within 14 days. If any defects of the purchased product are detected, MORIA DESIGN will respect the Customer's statutory rights. The procedure for filing a complaint is specified in the tab Complaint.
14 Personal data

15. intellectual property rights
All rights to the Shop, the materials and the MORIA DESIGN brand belong to us.
It is forbidden to use the Shop in a way that infringes the rights of MORIA DESIGN or others. If an infringement of intellectual property rights is noted, the owner of the rights will take appropriate legal action against the infringer.
The MORIA DESIGN designation, in both verbal and graphic form, identifies our company and functions in business dealings. MORIA DESIGN is our trade name.
It is forbidden to distribute any elements of the Shop without the written consent of MORIA DESIGN, including in particular the content as screenshots. It is forbidden to remove, cover up, or make illegible any trademarks, copyright notices or other markings relating to intellectual property rights. It is also forbidden any copying, circulation, distribution, modification of the content of the Account, including the creation of dependent works used without the prior written consent of the owner of the right.
By adding an opinion about a product, the Client declares that it belongs to him and grants a non-exclusive licence to MORIA DESIGN for the posted material, for a period of 99 years from the date of addition or for a shorter period if the material is removed by MORIA DESIGN in the following fields of exploitation:
- introduction into the memory of an electronic device (e.g. computer), including servers of information and communication systems, permanent and/or temporary recording and/or multiplication by any technique, in whole or in part, in an unlimited number of copies, in particular by means of any known polygraphic, digital, magnetic recording, copying, printing, multiplication by any video and computer technique, in any system, format and on any media, including exchange of media, including inter alia printing, in information and communication networks, digitally, public and/or non-public making available within the scope of provision of services by electronic means, free of charge, regardless of territorial, time and language limitations.This may include, but is not limited to, printing, information and communication networks, digitalisation, public and/or non-public communication in the context of electronic provision of services, free of charge, regardless of territorial, temporal and linguistic restrictions,
- the public and/or non-public dissemination by any means of wireless or wired transmission of signs, sounds and/or images, permanently and/or temporarily, in any technology, free of charge at a place and time chosen by other users and/or third parties,
- located on the network in such a way that it can be viewed by other Users and/or third parties as well as sent on request.
16 Final provisions
We reserve the right to make changes to the Terms and Conditions. Each document is marked with the date from which its provisions apply.
The Customer will be informed of each significant change to the Terms and Conditions at least 14 days before the new Terms and Conditions are due to come into effect, provided that he or she has an Account in the Store. If the Customer does not have an Account in the Store, the Rules and Regulations must be accepted each time at the stage of placing an order.
If the Terms and Conditions are changed, the Customer has the right to terminate the contract until the new Terms and Conditions are due to come into force. Failure to notify the Customer of the intention to terminate the contract or to terminate it by that time shall be deemed the Customer's consent to perform the contract in accordance with the new Rules and Regulations. This does not apply to changes with respect to the performance of orders already placed (they are carried out on the basis of the validity of the rules from the day of placing the order).
In matters not regulated by these Terms and Conditions, the relevant provisions of Polish law and/or the provisions applicable to the place of residence of the consumer's right shall apply.
Should any provision of the Terms and Conditions of Use be amended and/or invalidated by a final court decision, the remaining provisions shall remain in full force and effect.
Any disputes between the Service Provider and the company will be settled by the court having jurisdiction over the Service Provider's registered office.
